Juvenile Restorative Justice
:
SB 399 has been the recent priority. This bill allows for the review and resentencing of youth previously sentenced to life without parole. When youth do not have the possibility of parole they often do not get access to programs and rehabilitative services. For background info. in English or Spanish. CCC Bishops position on SB 399.

Challenge Racial Discrimination in the DP

In CA, Latinos comprised a staggering 50 percent of new death sentences in 2007, 38 percent of death sentences in 2008, and 31 percent of death sentences in 2009. In contrast, Latinos comprised only 16 percent of those sentenced to death in 2001.

California's Revised Execution Protocols Rejected

Citing inconsistency within the new protocols and violations of other state laws, the Office of Administrative Law (OAL) this week rejected the state's new execution protocols. OAL's job is to ensure that laws are "clear, necessary, legally valid, and available to the public," according to its website.

The new protocols were required when a San Jose Federal Court judge ruled that the previous execution procedure might constitute "cruel and unusual punishment." The California Department of Corrections and Rehabilitation (CDCR) rewrote the procedure for lethal injection of condemned inmates and in response, built a new death chamber at San Quentin

As required by law, they also opened the protocols to public comments, resulting in more than 20,000 public objections to the procedure. For instance, prison chaplains were required to give officials an assessment of an inmate's readiness for execution. (Read Chaplains Proposed Role in Executions Called into Doubt.)

In addition to its main concerns - that the protocols conflict with other state laws and new forms which were not even consistent within the new protocols -- OAL pointed to the CDRC's failure to respond to many of the public comments. CDCR must now revise the protocols and open them up for public comment again. They have until October of this year to "revise the revisions."

Over 12,000 Object to California’s Execution Plan

Wide range of groups and individuals say lethal injection proposal continues to be flawed

"Over 12,000 individuals, from California and across the country, have submitted comments objecting to the new execution plan recently released by the California Department of Corrections and Rehabilitation (CDCR). The revised plan, released for public comment on January 4, 2010, is part of the CDCR's efforts to kick-start executions which have been on hold in California for four years."

Bishop's Testimony to Repeal the Death Penalty: Kansas

Bishop Michael Jackels of Wichita testified before the Kansas Senate Judiciary Committee on behalf of legislation that would repeal the death penalty statute in our state. Under the bill, life without parole would replace capital punishment.
